Referral Terms

By participating in the Referral Program, you agree to be bound by these Referral Terms. If you object to anything in, or otherwise do not agree to, these Referral Terms you are not authorised to participate in the Referral Program. You must not participate in the Referral Program in any way other than in accordance with these Referral Terms.

These Referral Terms are in addition to, and subject to, the Terms and Conditions and the Privacy Policy and any other terms and conditions contained elsewhere on the Juggle Street Platform.

What is the Referral Program?

Juggle Street has established the Referral Program for the purpose of enabling Registered Users to spread the word about Juggle Street.

The Referral Program is only available to Registered Users.

Under the Referral Program a Registered User may share a Referral Link via the Juggle Street Platform with a friend or family member.

A Referrer will receive an eGift with the gift value published from time to time on the Juggle Street Platform for each Referred User.

A Referred User will receive the amount published from time to time on the Juggle Street Platform off their Helper Fee or Juggler Fee (as applicable).

By participating in the Referral Program, each Referred User consents, and agrees, to Juggle Street disclosing to the relevant Referrer that they have registered to access and use the Juggle Street Platform using the Referral Link shared by that Referrer.

Obligations

You must not, and warrant that you will not:

• participate in the Referral Program for any purpose other than for its intended purpose;
• refer yourself or register to access or use the Juggle Street Platform by automated means or under false or fraudulent pretences;
• distribute the Referral Link by bulk email or in a way that may be considered spam or distribution to strangers, or by posting on a third party deal or discount site or other publicly accessible website;
• participate in the Referral Program in any way which interferes with any other person participating in the Referral Program or defames, abuses, harasses, threatens, menaces or offends any person or prevents any person from participating in or enjoying the Referral Program;
• participate in the Referral Program in any way which violates these Referral Terms, any law or any rights of any third party;
• participate in the Referral Program in any way which is obscene, indecent, inflammatory, pornographic, threatening, harassing, deceptive, fraudulent or otherwise offensive or illegal or which is defamatory of any person or invasive of another person’s privacy; or
• attempt any of the above acts or similar acts or engage or permit another person to do any of the above acts or similar acts.

Termination

Juggle Street reserves the right, but has no obligation, to monitor or review any participation in the Referral Program.

Juggle Street may in our sole discretion refuse to provide a referral reward or cancel a referral reward if we believe that you have breached these Referral Terms or if we consider in our sole discretion that it is otherwise appropriate, necessary or desirable to do so.

Juggle Street may immediately suspend or terminate your account or otherwise limit your access to, and use of, the Juggle Street Platform if we believe that you have breached these Referral Terms or if we consider in our sole discretion that it is otherwise appropriate, necessary or desirable to do so.

General

Juggle Street may suspend, change or cancel the Referral Program at any time without prior notice.

From time to time, Juggle Street may change these Referral Terms by publishing the amended Referral Terms on the Juggle Street Platform. By participating in the Referral Program after any amendment becomes effective, you agree to be bound by the Referral Terms as amended.

Any failure or delay in exercise, or partial exercise, of a right arising from a breach of these Referral Terms does not result in a waiver of that right.

If the whole or any part, or the application, of any provision of these Referral Terms is void, illegal or unenforceable in any jurisdiction it is severed for that jurisdiction. The remainder of these Referral Terms has full force and effect and the validity or enforceability of that provision in any other jurisdiction is not affected. This paragraph has no effect if the severance alters the basic nature of these Referral Terms or is contrary to public policy.

Your participation in the Referral Program is governed by, interpreted and enforced in accordance with the laws of New South Wales. Disputes arising from your participation in the Referral Program are exclusively subject to the jurisdiction of the courts of New South Wales.

Definitions

Capitalised terms used in these Referral Terms are defined as follows:

eGift means an electronic gift card;

Eligible Business means businesses (including childcare centre operators, babysitting or nanny agencies, tutoring centre operators, tutor agencies, recruitment agencies and creche or other similar childminding operators), bodies corporate or other similar entities which comply with the requirements of the Terms and Conditions;

Helper means an individual who is looking to provide Services and eligible to register as a “Helper” on the Juggle Street Platform. Businesses (including childcare centre operators, babysitting or nanny agencies, tutoring centre operators, tutor agencies, recruitment agencies and creche or other similar childminding operators), bodies corporate or other similar entities are not permitted to register to be Helpers on the Juggle Street Platform;

Helper Fee has the meaning given in the “Helpers” section of the Terms and Conditions;

including means including without limitation;

Juggle Street, we, us or our means Juggle Street Pty Ltd ABN 80 600 449 938 of Level 2, 11 York Street, Sydney NSW 2000;

Juggler means an individual or Eligible Business looking for an individual to provide Services to them and eligible to register as a “Juggler” on the Juggle Street Platform;

Juggler Fee has the meaning given in the “Jugglers” section of the Terms and Conditions;

Juggle Street Platform includes the website located at www.jugglestreet.com, www.jugglestreet.com.au, //web.jugglestreet.com, //m.jugglestreet.com, all related webpages and downloadable Apps and associated customer support;

Privacy Policy means the Juggle Street privacy policy published on the Juggle Street Platform, as amended from time to time;

Referral Link means a unique referral link generated by Juggle Street for the purpose of making referrals under the Referral Program;

Referral Program means the Juggle Street referral program governed by these Referral Terms;

Referred User means a friend or family member of a Referrer who:

• registers to access and use the Juggle Street Platform in accordance with the Terms and Conditions using the Referral Link shared by the Referrer; and
• is not currently, or has never previously been, registered to access and use the Juggle Street Platform; and
• is currently located in the same country as the Referrer;

Referrer means a Registered User who shares a Referral Link via the Juggle Street Platform with a friend or family member;

Registered User means a Helper or Juggler registered to access and use the Juggle Street Platform in accordance with the Terms and Conditions and in good standing;

Services means babysitting, nanny, outside school hours care, au pair, early childcare education, tutoring and other similar childcare services;

Terms and Conditions means the terms and conditions of access to, and use of, the Juggle Street Platform published on the Juggle Street Platform, as amended from time to time;

you or your means anyone participating in the Referral Program.
