Juggle Street General Liability Insurance

Important notice

Unless otherwise indicated, please note that all capitalised terms in this summary have the same meaning as set out in the Juggle Street Terms & Conditions. In conjunction with our alliance insurance broker, Aon Risk Services Australia Limited ABN 17 000 434 720 AFSL 242411 (Aon), we have prepared the below summary of the Juggle Street General Liability Insurance policy (Policy).

This Policy is made available to Jugglers (e.g. a parent or legal guardian of a child) who:

  • hold a subscription based membership with Juggle Street;
  • validly post and award a job to a Carer via the Juggle Street platform in accordance with the terms and conditions issued by Juggle Street; and
  • abide by the terms and conditions of the Policy

Please note that this summary does not contain all the terms and conditions of the Policy and Policy Schedule which together comprise the insurance contact, so you should refer to these documents for full terms and conditions. A copy of the Policy and Policy Schedule will be provided to eligible Jugglers upon request.

How has this policy been arranged?

The Policy is made available to eligible Jugglers under a group policy issued to Juggle Street Pty Ltd ABN 80 600 449 938 (Juggle Street) by QBE Insurance (Australia) Pty Ltd ABN 78 003 191 035 (QBE). The policy intermediary is Aon Risk Services Australia Limited ABN 17 000 434 720, AFSL 241141 (Aon). Access to the group policy is provided to eligible Jugglers solely by statutory operation of section 48 of the Insurance Contracts Act 1984 (Cth).

Eligible Jugglers are not a party to the group policy, do not have an agreement with QBE and cannot vary or cancel the cover. Juggle Street is not the insurer, does not guarantee or hold the rights under the group policy on trust for eligible Jugglers and does not act as QBE’s agent. How does the Aggregate Limit of Liability and Sub-limit work?

A Group Policy Limit of $20,000,000 in respect of any one claim and in the aggregate, applies in respect of Product Liability cover and claims for Pollution under this group policy. A Sub-Limit of $250,000 also applies to claims for Property in the Insured’s Care, Custody and Control. As this is a group policy, the Limit of Liability and total Aggregate Limit of Liability is shared by all the Insureds.

This means that if the Limit of Liability and/or Aggregate Limit of Liability are exhausted by Claims against some of the Insureds during the Period of Insurance then there will be no cover remaining for the duration of that period of insurance. In accordance with the terms of the Group Policy, the Insurer may agree to include additional Insureds during the Policy Period. Any inclusion of additional Insureds during the Period of Insurance will not increase the Limit of Liability or the Total Aggregate Limit of Liability. The Insurer is not obliged to obtain the consent of the Insured before agreeing to extend the Group Policy to include new Insureds during the Period of Insurance.

Juggle Street General Liability Insurance

Juggle Street General Liability Insurance is a public liability policy designed to cover certain eligible Jugglers for their legal liability arising from damage to property or personal injury to third parties (e.g. Carers) as a result of placing a Carer in a job via the Juggle Street platform in accordance with the Juggle Street Terms & Conditions. Further information about who can access the Policy and the Policy itself is set out below.

Who is covered?

One major benefit of having a subscription-based membership with Juggle Street is that Jugglers then become eligible to access coverage under the Policy on a complimentary basis.

Eligible Jugglers are parents or legal guardians who are granting jobs to Carers through Juggle Street platform in accordance with the Juggle Street Terms & Conditions, who have a subscription-based membership and who comply with the terms of the Policy and Juggle Street’s terms and conditions (Eligible Juggler). The only cost payable is an excess of $1000 if an Eligible Juggler makes a claim.

Please note that Jugglers granting one-off jobs to Carers are not eligible for the Policy. Please refer to Juggle Street’s Terms & Conditions for further information about the eligibility criteria of Jugglers.

This Policy is not for the benefit of Carers. In other words, Carers cannot make a claim directly in respect of their liability, legal or otherwise. A claim for loss to their property or personal injury would need to be made to the eligible Juggler who is entitled to make a claim under the Policy by following the process set out below.

What liabilities aren’t covered?

The Policy doesn’t cover the following liabilities:

  • Legal liability arising from any circumstances as a result of a job not being validly posted, applied and awarded via the Juggle Street platform in accordance with the Juggle Street Terms & Conditions. Note that jobs arranged solely via the online chat functionality of the Juggle Street platform are not eligible for the insurance cover;
  • Legal liability for circumstances unrelated to a job placed via the Juggle Street platform, regardless of whether the Carer is registered on the Juggle Street platform or is any other third party; or
  • Any claim arising from actual or alleged sexual assault or molestation.

Insurance FAQs

How can a parent access coverage under the Juggle Street General Liability Insurance policy?

Access to coverage under the Policy is subject to and conditional upon compliance with the terms and conditions of the Policy, as well as the Juggle Street Terms & Conditions. Please carefully read and understand the Juggle Street Terms & Conditions as they contain important information about eligibility criteria such as:

  • Registration – you must be eligible to register on the Juggle Street platform. You will not be eligible to register if you have been the subject of a complaint, restraining order, charge or any other legal action involving violence, abuse, neglect or any other offence that involves endangering the safety of others.
  • You will keep all information provided by you to the Juggle Street platform, including your profile, up to date.
  • You will not act in a manner which is unlawful or likely to injure people or property.
  • You agree to indemnify and hold harmless Juggle Street and its directors, officers, employees and agents, for any claims made against them and any loss, expense, damage or liability incurred by them in any way related to your use of, or inability to use, the Juggle Street Platform, or your acts or omissions (online or offline) in any way related to the Juggle Street Platform (including any breach by of the Juggle Street Terms and Conditions).

How does the Juggle Street General Liability Insurance work for Jugglers?

If an Eligible Juggler becomes legally liable to pay compensation due to any third party personal injury or property damage occurring in connection with a job placed via the Juggle Street platform and where the Eligible Juggler has complied by the Juggle Street Terms & Conditions, the Juggle Street General Liability Insurance policy is designed to help indemnify the Eligible Juggler for any legal costs and other expenses reasonably incurred in accordance with the terms of the Policy.
In the event of any circumstance arising, the Juggler must not:

  • Make any admission of guilt or liability to any other party;
  • Make any promise of compensation to any other party, without express consent of the Insurer;
  • Act in any other manner which may prejudice the outcome of any claim.

Is there an excess?

As stated above, a Policy excess of $1,000 is applicable on any claims made under the Policy, and must be paid in full by the Juggler during the management of the claim

How do I make a claim?

If an Eligible Juggler needs to lodge a claim, they should immediately email full details of the claim to Aon at [email protected]The Juggler will then be required to:

  • Arrange for the completion of an Incident Report Form;
  • Pay the applicable excess
